  3. 1.  Apple Computer, Inc. Products Available through the APDA Tools Catalog
  4.   a. Software Products Subject to License
  5.      All Apple Computer, Inc. software products available to you through the
  6.      APDA Tools Catalog are licensed to you, not sold, under the terms of a
  7.      software license that is shipped to you with the product. By using the
  8.      product, you agree to be bound by the terms of the Apple Software
  9.      License that accompanies the product.  You may obtain a copy of the
  10.      Apple Software License for a given product in advance of ordering the
  11.      product, or if you determine after receiving a product that you do not
  12.      agree with the terms of the accompanying software license, you may return
  13.      the product to APDA for a full refund.
  14.   b. No Right to Redistribute
  15.      You do not have any right to copy, sublicense or otherwise
  16.      distribute any Apple Computer, Inc. software products that you have
  17.      ordered from the APDA Tools Catalog, except as may be expressly provided
  18.      in the Apple Software License that accompanies the product.  Site and
  19.      distribution licenses for some products are available to qualifying
  20.      individuals or entities under the terms of a separate agreement.  For

  28.    c. Nature of Products
  29.       The APDA Tools Catalog offers its customers a wide range of valuable and
  30.       sophisticated Apple software programming tools.  APDA does not, however,
  31.       provide its customers with technical support for the use of such
  32.       products.  When choosing and ordering products through the APDA Tools
  33.       Catalog, moreover, it is extremely important that you understand and
  34.       consider that many of the software products available to you through the
  35.       APDA Tools Catalog are not fully tested.  The untested nature of certain
  36.       products are clearly indicated in the APDA Tools Catalog listing for
  37.       those products. These products may contain errors that could cause system
  38.       failures or loss of data.  Further, some of these products do not come
  39.       with supporting documentation or in some cases the documentation for such
  40.       a product may be incomplete or contain inaccuracies. Therefore you assume
  41.       all risk of loss when using such software products. The license fees for
  42.       these products reflects this allocation of risk. Consult the Apple
  43.       Software License for a given product for warranty information.

  45. 2. Non-Apple Products Available through the APDA Tools Catalog
  46.    Software and other products from third-party manufacturers available
  47.    through the APDA Tools Catalog range from full commercial versions to
  48.    preliminary releases.  License agreements, warranties, commercial
  49.    redistribution policies and other conditions vary with the product and are
  50.    the responsibility of the manufacturer.

  52. 3. Hours of Operation
  53.    Customer Service Representatives will be available for your calls from
  54.    Monday through Friday of each week, 7:00 a.m. to 5:00 p.m., Pacific Time.

  56. 4. Taxes
  57.    Apple Computer, Inc. conducts business in every state of the United
  58.    States.  This requires us to charge state tax on every domestic order we
  59.    receive, regardless of where the order originated within the United States.

  61. If you are purchasing non Class 1 products, a completed and signed copy
  62. of this form must be on file or accompany the order.  This form need
  63. only be completed and signed once, as it will remain current in our
  64. files.
